These Terms of Service (the "Terms") govern your use of PayStubNest at https://www.paystubnest.com (the "Service"), operated by PayStubNest.com ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Acceptable Use Policy, which is part of these Terms. If you do not agree, do not use the Service.
1. What the Service is
PayStubNest is a payroll record-keeping tool. It lets employers, small businesses, self-employed people, contractors and bookkeepers enter pay details, have federal and state withholding and year-to-date totals calculated, and download pay stubs as PDF documents for their payroll records.
The Service is not a payroll provider, bank, employer of record, tax preparer or income-verification service. We do not pay wages, file or remit taxes, issue W-2 or 1099 forms, or verify anyone's employment or income. Tax figures are calculated by a third-party payroll engine from published tax tables for the supported tax years; you are responsible for checking every figure before you use a document.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You must give accurate account information and keep it up to date.
- You are responsible for everything done under your account. Keep your password confidential, use two-factor authentication where offered, and tell us at support@paystubnest.com if you suspect unauthorized use.
- One person or business may not open accounts to evade a suspension or termination.
3. Your responsibilities for pay stub content
You may only create pay stubs that reflect real, accurate payroll information for pay that was actually issued or received. Before a pay stub is unlocked or downloaded you will be asked to confirm that the information is accurate; that confirmation is recorded with its date, time, IP address and browser. You are solely responsible for the information you enter, for the documents you generate and for how you use them. The full rules are in the Acceptable Use Policy.
4. Credits, plans and payment
- Previews are free. Downloading a pay stub uses one credit or is covered by an active plan, as shown before you confirm.
- Prices, credit validity and plan limits are shown at checkout. Prices are in US dollars unless stated otherwise and exclude any taxes that apply.
- Payments are processed by our payment providers. We do not store full card numbers; we keep only a token, the card brand and its last four digits.
- Subscriptions renew automatically at the end of each period until cancelled. You can cancel at any time from the Billing page; cancellation takes effect at the end of the current period.
- Credits have no cash value, cannot be transferred or exchanged for money, and expire as stated at purchase.
- Refunds are handled under our Refund Policy.
5. Suspension and termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms or the Acceptable Use Policy, if required by law or by our payment providers, or to protect the Service or others. Accounts terminated for misuse are closed without refund of unused credits or subscription fees. You may close your account at any time by contacting support@paystubnest.com.
6. Cooperation with authorities
We may preserve and disclose account information, generated documents and attestation records to law enforcement, regulators or affected parties when we believe in good faith that the law requires it or that it is necessary to investigate or prevent fraud or misuse.
7. Intellectual property
The Service, its software, designs and ready-made templates belong to PayStubNest.com or its licensors. You keep ownership of the data and logos you upload and give us a limited licence to host and process them only to provide the Service. You may use the documents you generate for your own lawful payroll record-keeping.
8. Third-party services
The Service relies on third parties, including the payroll calculation engine, payment processors, email delivery and hosting providers. Their availability is outside our control.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that calculations are free of error or suitable for any particular purpose, and nothing in the Service is tax, legal or accounting advice. Consult a qualified professional for advice about your situation.
10. Limitation of liability
To the fullest extent permitted by law, PayStubNest.com will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim.
11. Indemnity
You agree to indemnify and hold harmless PayStubNest.com and its officers, employees and agents from any claim, loss or expense (including reasonable legal fees) arising from your use of the Service, the documents you create, or your breach of these Terms or of the law.
12. Changes to these Terms
We may update these Terms. Every published change gets a new version number. When the Terms or the Acceptable Use Policy change, you will be asked to accept the new version before you continue using your account.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Orange County, California, unless applicable law requires otherwise.
